1. Acceptance of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between your business organization (“Merchant,” “Customer,” “you,” or “your”) and Tap4Review (“Tap4Review,” “we,” “our,” or “us”). By accessing our website (tap4review.us), registering an account, or deploying our NFC cards or QR stands, you agree to be bound by these Terms.

2. Description of Services & Hardware

Tap4Review provides commercial Near Field Communication (NFC) cards, acrylic table stands, counter pucks, and window decals pre-programmed with location-specific routing URLs, together with cloud software for review analytics, real-time alert notifications, and private guest feedback inboxing.

3. Non-Gating & Review Policy Compliance Guarantee

Tap4Review is engineered to adhere strictly to the Federal Trade Commission (FTC) guidelines on customer reviews and platform developer policies (including Google LLC Review Policies):

• Universal Access: All dining guests, regardless of whether they select 1 star or 5 stars, are presented with unobstructed, equal access to leave a public review on the venue’s official Google review listing.
• No Review Suppression: Merchants agree not to use the service in an attempt to unlawfully condition, deceive, manipulate, or filter customer reviews.
• No Financial Incentivization: Merchants may not offer monetary compensation, free meals, or gifts conditioned upon a customer posting a positive review on any public review platform.

4. Subscription Plans, Billing & Cancellations

Tap4Review offers tiered subscription plans (Trial, Starter, Professional, Enterprise, and designated commercial lifetime licenses):

• Billing Cycles: Paid recurring subscriptions are billed in advance on a monthly or annual basis. Charges are processed automatically via authorized payment methods.
• Cancellation Policy: You may cancel your subscription at any time directly within your owner dashboard. Upon cancellation, your service remains active through the conclusion of the current paid billing period without further automatic renewal charges.
• Fee Revisions: Price adjustments for upcoming billing periods will be communicated at least thirty (30) days in advance via email.

5. Hardware Fulfillment & Replacement Warranty

All pre-programmed NFC review cards and acrylic stands are tested before shipment and delivered to the business address specified upon onboarding.

We provide a comprehensive one-year hardware warranty against NFC chip manufacturing defects under standard restaurant and commercial retail use. Damaged or non-responsive cards will be reprogrammed and replaced promptly upon request.

6. Merchant Responsibilities Regarding Guest Contact Data

When dining guests submit private feedback, they provide contact details (including full name, telephone number, and email address) for direct management follow-up:

• Merchants agree to use submitted guest contact information exclusively for responding to the guest’s specific meal, service, or dining experience.
• Merchants are strictly prohibited from exporting, selling, or adding guest contact details to third-party bulk marketing campaigns or unsolicited sales lists.
• Merchants must comply with all applicable telecommunications, privacy, and consumer protection laws (including TCPA and CAN-SPAM).

7. Intellectual Property & Trademarks

Tap4Review retains all rights, title, and interest in its proprietary software, branding, hardware designs, and documentation. Google, Google Maps, and the Google logo are registered trademarks of Google LLC. Tap4Review is an independent software and hardware provider and is not endorsed by, sponsored by, or affiliated with Google LLC.

8. Disclaimers & Limitation of Liability

Tap4Review is provided “as is” and “as available.” While our technology facilitates frictionless review submission, we make no representation or warranty regarding the volume, numerical star value, or search engine ranking impact of reviews submitted by third-party consumers.

To the maximum extent permitted by applicable law, Tap4Review’s aggregate liability for any claims arising under these Terms shall be limited to the total subscription fees paid by Customer during the twelve (12) months preceding the incident.

9. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be resolved in the state or federal courts located in Travis County, Texas.
